Karamychev v. District of Columbia, 772 A.2d 806 (D.C. 2001)
DUI conviction AFFIRMED where the driver refused chemical testing entirely. Full opinion read. Holds the evidence sufficient on the officer's observations and roadside sobriety tests, restating that a person is guilty if "to the slightest degree... less able, either mentally or physically or both, to exercise the clear judgment and steady hand" needed to drive safely, and that "[t]he prosecution need not prove any specific degree of intoxication." Also holds lay witnesses including police officers may give opinion testimony that a driver appeared to be under the influence, and that refusal of chemical testing is itself evidence of consciousness of guilt.
