Tax Questions

Attorney-reviewed answers on IRS collection, cancelled debt and filing status — free and with no obligation.

The tax questions people actually ask are rarely about return preparation. They are about what happens when you cannot pay, when a form arrives that nobody explained, or when a family’s immigration status complicates an otherwise ordinary return.

The most useful thing people do not know is that the IRS has a formal hardship process. Where paying would leave you unable to meet basic living expenses, active collection can be paused and a levy has to be released. Interest keeps accruing and the debt does not vanish, but it is a real status with a real application — not an appeal to sympathy.

The most common misunderstanding is the 1099-C. A lender reports a cancelled debt because the written-off amount is generally taxable income to you. It says nothing about who owns the property the debt was attached to. Those are two separate questions, and the form answers only one of them.
