Auto Accident Questions

Attorney-reviewed answers on collisions, fault, vehicle damage and auto insurers — free and with no obligation.

Auto accident questions run from the first hours after a collision — who was at fault, who pays for the vehicle, whether to give a recorded statement — through the months that follow, when medical bills arrive, an adjuster makes an offer, and a lien or subrogation demand shows up against money you have not received yet. The legal questions change as the file ages, and the answers depend heavily on which state's rules apply.

Two things surprise people most. The first is that fault is rarely all-or-nothing: most states reduce recovery by your share of the blame, and a few bar it entirely once your share passes a threshold, so an adjuster's early apportionment is worth understanding rather than accepting. The second is that the insurer handling your claim is not neutral, even when it is your own — a first-party claim under your uninsured or underinsured coverage is still a claim against a company whose interests differ from yours.

Deadlines here are shorter than people expect and vary by state, and some notice requirements run in weeks rather than years. If a claim matters, the time to ask is early.
